THE WEBSITE: tuesdayfoods.co (THE “WEBSITE” OR THE “SITE”) IS OWNED AND OPERATED BY GOOD CLEAN FOOD CO, LLC. D/B/A TUESDAY FOODS, WE OR US. THE SITE IS OFFERED TO YOU CONDITIONED ON YOUR ACCEPTANCE WITHOUT MODIFICATION OF THE TERMS, CONDITIONS AND NOTICES HEREIN (THE “TERMS”), WHICH GOVERN YOUR USE OF THE SITE AND THE SERVICES PROVIDED ON THE SITE. IF YOU DO NOT AGREE WITH THESE TERMS, INCLUDING OUR PRIVACY POLICY, YOU MUST NOT USE OR ACCESS THE SITE. IF YOU ARE USING THE SITE OR SERVICES ON BEHALF OF ANY OTHER PERSON OR ENTITY, YOU REPRESENT AND WARRANT THAT YOU HAVE AUTHORITY TO ACCEPT THESE TERMS ON BEHALF OF SUCH OTHER PERSON OR ENTITY AND THAT SUCH OTHER PERSON OR ENTITY AGREES TO BE BOUND BY THESE TERMS.
WE PROVIDE PLANT-BASED MEALS AND DELIVERY SERVICES. THE MEALS ARE OUR “PRODUCTS” AND DELIVERY AND OTHER RELATED SERVICES ARE THE “SERVICES.”
BY USING OR ACCESSING THE SITE OR OUR PRODUCTS OR SERVICES, YOU REPRESENT THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS OF USE AND THAT YOU ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH US. FURTHER YOU AGREE TO ABIDE BY ALL APPLICABLE LAWS AND REGULATIONS THAT APPLY TO YOU, REGARDLESS OF YOUR PHYSICAL LOCATION.
ANY DISPUTE, CLAIM OR REQUEST FOR RELIEF RELATING IN ANY WAY TO YOUR USE UF THE SITE WILL BE GOVERNED AND INTERPRETED BY AND UNDER THE LAWS OF THE STATE OF COLORADO CONSISTENT WITH THE FEDERAL ARBITRATION ACT, WITHOUT GIVING EFFECT TO ANY PRINCIPLES THAT PROVIDE FOR THE APPLICATION OF LAW OF ANY JURISDICTION.
Changes to Terms of Use, Website or Privacy Policy
We may change these Terms, the Site, or our Privacy Policy at any time in our sole discretion with or without notice. You can review the most current version of the Terms by clicking on the “Terms of Use” link, located at the bottom of our website, at www.goodcleanfoodco.com/terms. You are responsible for checking the Terms and Privacy Policy periodically for changes. If you continue to use the Site or our Products or Services after we post changes to the Terms or Privacy Policy, you are signifying your acceptance of the new Terms and Privacy Policy as well as the changes in the Site, Products or Services. Our Privacy Policy is located at www.goodcleanfoodco.com/privacy-policy. If you do not accept any changes your sole remedy is to not use the Site, Products or Services. The Terms are effective as of January 31, 2021.
Purchases and Payment
If you wish to purchase any Product or Service made available through the Site or redeem a Gift Card (“Purchase”), you must supply payment information including, without limitation, your first and last name, phone number, payment card number, expiration month, billing address, and delivery information. Your payment card will be charged for Purchases at time of checkout.
By making a Purchase and providing payment information, you authorize us (or our third party payment processor) to charge your payment method for the total amount of your Purchase (including any applicable taxes and other charges). If the payment method cannot be verified, is invalid or is otherwise not acceptable, your Purchase may be suspended or cancelled. You must resolve any problem we encounter in order to proceed with your Purchase. You can change or update payment information at any time by logging into your account and revising your information.
By providing payment information, you represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the Purchase. We reserve the right to refuse or cancel your Purchase at any time for certain reasons including but not limited to: Product or Service availability, errors in the description or price of the Product or Service, errors in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
All prices shown are in U.S. dollars and do not include applicable taxes. Taxes may vary and are not within our control. We may adjust future prices as necessary, in our sole discretion. By making a Purchase, you agree to pay the then-current Purchase price and any and all applicable taxes. Purchases are not to be used for resale or any commercial purposes.
Availability, Substitutions, Errors and Inaccuracies
We are constantly updating our offerings of Products and Services and changing how we bundle them. The Products or Services available on our Site may be mis-priced, described inaccurately, or unavailable, and we may experience delays in updating information on the Site and in our advertising on other web sites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and Services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. We reserve the right to change, discontinue or limit availability of Products, Menus, or Services in our sole discretion. Due to the perishable nature of our meal ingredients, we reserve the right to substitute products and ingredients without prior notice.
Accounts and Passwords
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password, whether your password is with our Services or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
Product and Service Availability
Our Products and Services are intended for use by individuals located in the following zip codes of Colorado (“Serviced Area”) At this time we do not accept orders from individuals for delivery outside the Serviced Area.
Notes On Perishability
All Tuesday Foods meals should be kept refrigerated until consumed and freshness cannot be guaranteed past the 5th day from receipt. It is up to the client to maintain freshness once received. Our meals are delivered in insulated cooler bags with ice packs and will typically remain cold and fresh for several hours. Depending on the season and temperature at the time of delivery, advance planning by you should be made for immediate and proper storage of your meals. It’s important to put your Tuesday Foods meals and perishable items in the refrigerator when you receive them. Smoothies go in the freezer. By purchasing the Tuesday Foods organic meal delivery program, you agree to properly and promptly refrigerate all meals until you plan to eat them. Since all of our food is fresh (and preservative-free and chemical-free), it will go bad if not properly stored and refrigerated.
Your Responsibility to Inspect your Deliveries
You are solely responsible for inspecting all meal ingredients you receive for any damage or other issues upon delivery and for determining the freshness of the ingredients you receive. You should always inspect your delivery to confirm that the meal ingredients arrive in a cool, refrigerated condition.
If you are not home when your order is delivered, the delivery driver will leave it at your address. Orders are insulated and packaged with cold packs, which will keep them stable and temperature-safe for up to 2 hours after delivery. If a delivery cannot be safely left at your address, you are responsible for making alternate arrangements and for changing your delivery instructions in your account if necessary. Any person or location that accepts delivery is presumed by us to be authorized to do so and in accordance with these Terms. You are solely responsible to safely store and refrigerate all products prior to use, including perishables.
We recommend that at all times you follow the USDA’s instructions on food storage and safe food handling, which can be found here: http://www.fsis.usda.gov/wps/portal/fsis/topics/food-safety-education/get-answers/food-safety-fact-sheets/safe-food-handling/keep-food-safe-food-safety-basics/ct_index. Failure to follow safe food handling practices and temperature recommendations may increase the risk of food-borne illness.
In addition, pregnant women, young children, the elderly and individuals with compromised immune systems should follow the U.S. Food and Drug Administration’s recommendations on food consumption for at-risk groups, which can be found here: http://www.fsis.usda.gov/wps/portal/fsis/topics/food-safety-education/get-answers/food-safety-fact-sheets/at-risk-populations.
YOU ARE SOLELY RESPONSIBLE FOR AND ASSUME ALL RISKS RELATED TO THE PROER AND SAFE PREPARATION (INCLUDING STORAGE, WASHING, AND COOKING), USE, AND CONSUMPTION OF THE PRODUCTS. AS SUCH, ALL CONTENTS IN THE PRODUCTS ARE PROVIDED “AS-IS” AND “AS-AVAILABLE,” AND TO THE FULLEST EXTENT ALLOWABLE UNDERA APPLICABLE LAW, ALL EXPRESS AND IMPLIED WARRANTIES ARE DISCLAIMED. THIS SPECIFICALLY INCLUDES BUT IS NOT LIMITED TO, THE WARRANTY FOR FITNESS FOR A PARTICULAR PURPOSE, WARRANTIES OF MERCHANTABILITY, AND WARRANTIES FOR THE NON-INFRINGEMENT OF INTELLECTUAL PROPERTY.
Returns, Replacements, Refunds
All sales are final and any canceled orders will receive a Tuesday Foods credit to be used on any future date. Delivery Dates are flexible and can be changed with 48 hours notice. *Credit Card refunds will not be honored. We are a small, local business and processing fees are too high to maintain.*

Gift Cards – Terms of Use
You may purchase or redeem a Gift Card towards a new or existing Tuesday Foods purchase by clicking on the “Good Clean Gift” tab on the Order Here page of our website and other pages on the Site. By purchasing or redeeming a Gift Card, you agree to the Gift Card Terms of Use in addition to these Terms. Tuesday Foods Gift Cards are issued and managed by Tuesday Foods and can be applied only to eligible purchases from tuesdayfoods.co in the U.S. There are no taxes on Gift Cards, but purchases made with Gift Cards may be subject to applicable taxes and delivery fees.
Gift Cards are not reloadable and may not be transferred to another Tuesday Foods account, redeemed for additional Tuesday Foods Gift Cards, or redeemed for cash (except as required by law), or for deliveries outside of our delivery zones. Tuesday Foods is not responsible for any lost or stolen Gift Cards or use without your permission. If a Gift Card is lost, it can be redeemed by whoever finds it. Gift Cards are valid for at least two (2) years from the date of issuance, in accordance with applicable law.
